Terms & Conditions of Use – Saya (Sultanate of Oman)

1. Acceptance of Terms

By using the Saya website, application, or services, you agree to comply with these Terms & Conditions. Saya reserves the right to update or modify these terms at any time, and continued use of the platform after updates constitutes acceptance of the revised version.

Nothing in these terms limits any rights granted to consumers under the laws of the Sultanate of Oman, including the Omani Consumer Protection Law and its Executive Regulations.

Eligibility & User Account

You must have full legal capacity according to the laws applicable in your country of residence and be able to provide a valid address within the Sultanate of Oman for delivery purposes.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

You must notify Saya immediately of any unauthorized use of your account.

Saya may request additional documents or information to verify identity or eligibility and reserves the right to suspend or terminate accounts in cases of violations or suspected unlawful activity.

Communications & Privacy

Saya may send service-related or promotional communications via email, SMS, or messaging applications.

You may opt out of promotional communications at any time through the unsubscribe link or by contacting customer service.

Your personal data will be processed in accordance with Saya’s Privacy Policy published on the website.

Orders, Pricing, VAT & Payment

All prices displayed on the website include applicable Value Added Tax (VAT) in the Sultanate of Oman unless otherwise stated.

Shipping fees and taxes, where applicable, will be clearly displayed during checkout.

VAT is calculated on the net value of products after discounts and promotional coupons. Shipping charges may also be subject to VAT according to applicable regulations.

Saya strives to ensure pricing accuracy; however, unintentional errors may occur. In such cases, Saya reserves the right to correct pricing errors or cancel orders after notifying the customer before processing.

Available payment methods are displayed during checkout.

For Cash on Delivery (COD) orders, Saya may request additional confirmation or restrict COD availability for certain regions or order values.

Shipping, Delivery & Click & Collect

Estimated delivery times are displayed during checkout and may vary due to logistics or circumstances beyond Saya’s control.

Customers will be notified in case of unusual delays, and suitable alternatives may be offered.

If delivery fails بسبب incorrect information or customer unavailability, the customer may be charged additional re-delivery or processing fees.

For Click & Collect orders, customers must collect their orders within the specified timeframe; otherwise, Saya may cancel the order and refund the amount after deducting any applicable fees.

Coupons & Promotional Offers

Coupons and promotional credits are non-transferable and cannot be exchanged for cash unless otherwise stated.

Unless specifically mentioned otherwise:

Only one coupon may be used per order.
Coupons cannot be combined with other offers.
The maximum discount through coupons is 5 OMR per order.

For “Buy One Get One Free” offers, the free item will always be the lower-priced product and must be added to the cart to qualify.

30% Cashback Coupon Program

To qualify for the offer, customers must:

Complete a purchase.
Fulfill the announced requirements, such as submitting a review or posting on Instagram according to Saya’s instructions.

The cashback coupon:

Equals 30% of eligible net purchases.
Is valid for 45 days.
Is non-transferable.
Cannot be redeemed for cash.

Saya reserves the right to verify participation and reject or cancel coupons in cases of misuse or violation of the offer terms.

Content & Reviews

Customer reviews and comments must:

Be genuine and accurate.
Not contain offensive or unlawful content.
Not violate third-party rights.

Saya reserves the right to review, reject, edit, or remove any content that violates these terms without prior notice.

Intellectual Property Rights

All website content, including:

Text,
Images,
Logos,
Designs,
Software,

is owned by Saya or its licensors and may not be copied, reproduced, distributed, or reused without prior written permission.

Prohibited Use

Users are prohibited from:

Misusing the website.
Attempting unauthorized access or bypassing security systems.
Collecting data automatically without permission.
Selling or transferring accounts or coupons.
Using the platform unlawfully or in ways that harm Saya’s reputation or users.

Cancellation & Suspension

Customers may request order cancellation only before the order has been shipped.

Once the order has been handed over to the shipping company, cancellation is no longer possible and the Return & Exchange Policy will apply.

Saya reserves the right to suspend accounts or cancel orders in cases of violations or suspected fraudulent activity.

If a prepaid order is canceled before shipment, refunds will be returned to the original payment method according to standard banking processing times.

Returns, Exchanges & Warranty

Returns, exchanges, and warranties are subject to Saya’s published Return & Exchange Policy.

Nothing in these terms affects the customer’s statutory rights under Omani law.

In cases of:

Manufacturing defects,
Incorrect products,
Or products not matching their description,

customers may request replacement, refund, or repair according to the published policy, and Saya will bear the shipping costs in such cases.

For hygiene and health reasons, certain beauty and personal care products may not be eligible for return or exchange after opening or use unless they are defective.

Force Majeure

Saya shall not be liable for delays or failure to fulfill obligations caused by circumstances beyond its reasonable control, including:

Natural disasters,
Government actions,
Public outages,
Major technical failures,
Or courier/shipping disruptions.

Limitation of Liability

To the maximum extent permitted by law, Saya shall not be liable for indirect, incidental, consequential, or loss of profit damages arising from the use of the website or services.

This limitation does not affect any non-excludable consumer rights under Omani law.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by the laws of the Sultanate of Oman.

Any disputes shall be subject to the jurisdiction of the competent courts in Muscat, without prejudice to any rights available to consumers before the relevant consumer protection authorities.
